Welcome to TrackMyCerts. By downloading, installing, or using the TrackMyCerts mobile application or website at trackmycerts.net, you agree to these Terms of Service ("Terms"). Please read them carefully.

1. About TrackMyCerts

TrackMyCerts is a personal certification tracking tool designed to help NYC construction workers and tradespeople organize, monitor, and receive reminders about their job-site certifications and licenses. TrackMyCerts is operated by TrackMyCerts LLC, a Delaware limited liability company ("we," "our," or "us").

2. Eligibility

You must be at least 18 years old to use TrackMyCerts. By using the app, you represent that you are 18 or older and have the legal capacity to enter into these Terms.

3. Your Account

You are responsible for:

• Keeping your login credentials secure and confidential.
• All activity that occurs under your account.
• Providing accurate information when creating your account.
• Notifying us immediately at support@trackmycerts.net if you suspect unauthorized access.

4. Acceptable Use

You agree to use TrackMyCerts only for lawful purposes and in accordance with these Terms. You agree not to:

• Use TrackMyCerts to store false, fraudulent, or fabricated certification information.
• Attempt to access another user's data without authorization.
• Reverse engineer, decompile, or tamper with the app or its backend systems.
• Use TrackMyCerts in any way that violates applicable federal, state, or local laws.
• Attempt to interfere with the proper functioning of our servers or networks.

5. Your Data

You own your data. TrackMyCerts does not claim any ownership rights over the certifications, photos, notes, or job history you store in the app.

You grant us a limited license to store and process your data solely to provide the TrackMyCerts service to you. We will never sell your data or use it for advertising.

You can export or delete your data at any time via Settings → Your Data in the app.

6. SMS Notifications

If you opt in to SMS text message reminders, you consent to receive text messages from TrackMyCerts about your expiring certifications and licenses. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP or turning off SMS in Settings → Notifications. Reply HELP for assistance.

We will never send SMS marketing messages unrelated to your certifications, and we will never sell your phone number.

7. Subscriptions & Payments

TrackMyCerts offers paid subscription plans including individual annual and monthly plans. Payments are processed by Stripe. By subscribing, you agree to Stripe's terms and authorize us to charge your payment method on the applicable billing cycle.

• Subscriptions automatically renew unless cancelled before the renewal date.
• You may cancel your subscription at any time through your account settings.
• Refunds are handled on a case-by-case basis — contact support@trackmycerts.net within 7 days of a charge if you have a concern.
• We offer a 90-day free trial for new users. No charge until the trial ends.

8. No Warranty — Certification Validity

TrackMyCerts is provided "as is." We make no warranty that:

• The app will be available at all times without interruption.
• Reminder notifications will be delivered without delay or failure.
• Certification expiry dates entered by users are accurate or up to date.
• Any certification tracked in the app is valid, recognized, or accepted by any employer, agency, or authority.

You are solely responsible for verifying your own certification status with issuing authorities. TrackMyCerts is a reminder and organizational tool only.

9. Limitation of Liability

To the fullest extent permitted by law, TrackMyCerts and its operator shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including but not limited to missed certification expirations, job loss, or regulatory penalties.

Our total liability to you for any claim arising from these Terms or your use of TrackMyCerts shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or use TrackMyCerts for fraudulent or harmful purposes. You may terminate your account at any time via Settings → Your Data → Delete All Data, or by emailing support@trackmycerts.net.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved in the state or federal courts located in Delaware.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Your continued use of TrackMyCerts after changes are posted constitutes your acceptance of the updated Terms.
